Terms of Service

1 · Who you're agreeing with

Everglow Dispatch is operated by Everglow Solutions LLC, a Florida limited liability company based in St. Augustine, Florida. In these terms "we", "us" and "Everglow" mean that company. "You" means the business that holds the account.

By creating an account or using the software you agree to these terms. If you're agreeing on behalf of a business, you're confirming you're allowed to.

2 · Your account

You're responsible for what happens under your account, including anything your staff or an API key does. Keep passwords and API keys private. Tell us promptly if you think someone has got in who shouldn't have.

You must be at least 18 and using the software for a business.

One account is one business. You can add as many users as your plan allows — on Crew and above, that's unlimited.

3 · Paying for it

Plans are billed monthly in advance at the price shown when you subscribe. Trials run 14 days and need no card. Nothing is charged until you choose a plan.

If a payment fails we'll retry and email you. Your account moves to past due, and after a reasonable period without payment we may suspend access. We won't delete your data for non-payment without telling you first.

We may change prices. Existing customers get at least 30 days' notice by email, and the new price applies from your next billing period. If you don't want it, cancel before then.

Payments are not refundable for partial months. If we've made a genuine mistake, email us and we'll make it right.

4 · Taking card payments

If you accept card payments from your own customers, that runs through your own Stripe account, connected through Stripe Connect. This matters:

• The Stripe account is yours, in your business name
• Funds settle directly to your bank. We never hold your money
• Stripe's fees are Stripe's. We take no percentage of your transactions
• Your relationship with Stripe is governed by Stripe's own agreement
• Chargebacks, disputes and refunds are between you, your customer and Stripe. We can help you find the record; we can't decide the outcome

We are not a payment processor, a money transmitter, or a party to transactions between you and your customers.

5 · Your data

Your data belongs to you. That includes your customer list, jobs, quotes, invoices, photos, signatures and everything else you put in.

We store and process it to run the service for you. We don't sell it, rent it, or share it with advertisers. We don't use it to train machine learning models.

You can export it whenever you like — CSV from Settings, or the API, which is on every plan.

If you connect your own AI

You can generate an API key and connect an assistant such as Claude or ChatGPT. If you do, your data goes to whichever provider you chose, under their terms, not ours. We log every call so you can see what happened, but we don't control what your provider does with it. Choosing that provider is your decision.

6 · What you can't do with it

• Break the law, or help someone else break it
• Store data you have no right to hold
• Send unsolicited bulk messages to people who didn't give you their details
• Try to break into other accounts, or probe the service for weaknesses without asking us first — email us and we'll usually say yes
• Resell the software as your own product
• Deliberately overload the service

If you find a security problem, tell us at help@everglowdispatch.com. We won't come after anyone acting in good faith.

7 · Uptime, and what we don't promise

We work hard to keep it running and we've built it to keep working when your signal doesn't. But we're a small company and we're not going to promise you a number we can't guarantee.

There is no uptime SLA on any plan. If that's a dealbreaker for your business, we'd rather you knew now.

The service is provided as-is. We don't warrant it will be uninterrupted, error-free, or fit for a particular purpose beyond what's described on the site.

Keep your own backups of anything you can't afford to lose. Export is free and always will be.

8 · Liability

To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim.

We're not liable for lost profits, lost business, lost data, or indirect or consequential losses.

Nothing here limits liability for anything that can't be limited by law — including fraud.

9 · Ending it

You can cancel any time from Settings. You keep access until the end of the period you've paid for. We don't charge a cancellation fee and we don't make you phone anyone.

Export your data before you go. After cancellation we keep it for 30 days in case you change your mind, then delete it. Ask us within those 30 days and we'll restore or export it for you.

We may suspend or end an account that breaks section 6, doesn't pay, or puts the service or other customers at risk. Except in serious cases we'll warn you first and give you a chance to fix it.

10 · Changes to these terms

We may update these terms. For anything material we'll email you at least 30 days beforehand. Continuing to use the service after that means you accept the new version. If you don't, cancel.

We won't quietly change the important parts. The date at the top of this page tells you when it last moved.

11 · Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute goes to the state or federal courts in St. Johns County, Florida, and we both agree to that.

If any part of these terms is unenforceable, the rest still stands.
